The protection of human rights in the ecuadorian criminal justice system [La protección de los derechos humanos en el proceso penal ecuatoriano]

The objective of this research article was to analyse the protection of human rights in Ecuadorian criminal proceedings. Using a qualitative descriptive-analytical approach, four fundamental dimensions are examined: 1) the constitutional framework of criminal proceedings, 2) guarantees of due process, 3) the protection of victims and vulnerable groups, 4) contemporary challenges in the global context. The results show that, despite the constitutionalisation of the criminal procedure system, practices that compromise fundamental rights persist, particularly in the application of precautionary measures and special procedures. The insufficiency of differentiated mechanisms for vulnerable groups and the intensification of challenges derived from phenomena such as globalisation and the pandemic are verified. It is concluded that it is necessary to strengthen procedural guarantees that establish effective limits to the punitive power of the state, harmonising procedural efficacy with the unrestricted protection of human rights in the Ecuadorian penal system.
