The aim of this research is to analyse the use of the state of emergency due to serious internal commotion as a way of avoiding state responsibility in Ecuador. Methodologically, we worked on the review of 18 documents from a legal-reflexive perspective with a descriptive scope. The indiscriminate or prolonged use of a state of emergency raises concerns regarding respect for human and civil rights, as well as sparking debates about the establishment of authoritarian measures. It is essential to establish precise time limits and periodic review mechanisms to avoid the erosion of democratic guarantees during periods of crisis.
